Research On The Issue Of Land Exproprition For The Major Construction Projects In Shandong Province

China is a country whose economy is developing rapidly, where public interest-driven strategically important construction projects have been approved and commenced one after another, among which land expropriation can’t be ignored. Shandong Province is an economically developed province. However, due to the frequent occurrence of the issue about land expropriation for South-to-North Water Diversion Project in Shandong Section, a representative major construction project in recent years, disharmonious and unstable factors have appeared in the society.Based on a case study of several typical subprojects in South-to-North Water Diversion Project in Shandong Section, this paper analyzed the procedure, compensation and resettlement of the land expropriation for the major construction projects of Shandong Province, finding some problems existing in the process of land expropriation for major construction projects, primarily including unclear property right,frequent controversial land issue, lower-priced compensation and resettlement for land acquisition, singular way of compensation and resettlement for land acquisition, lack of sound land market, failed optimal allocation of resources, defective social security for land-lost farmers, lack of legal safeguard and remedy for land-expropriated farmers in land expropriation process, short-term and unequal existing way of resettlement, and lack of social security for land-lost farmers.Against these problems, this paper(1) clarifies land property right to solve the issues of controversial land and ownership left over from history that occur frequently in the process of land expropriation for major construction projects, put forward some suggestions and countermeasures based on the current related policies and data, and tease out a right verification procedure;(2) enlarges financial channel and strengthens efforts for financial support, to rationally standardize and determine a price for the budget and compensation for land expropriation;(3) creates a new way of compensation and resettlement for land acquisition and introduces such new modes as reserved land resettlement and land-expropriated farmers’ pooling of land as shares by using other provinces’ experience in different projects for reference, to explore a feasible way for the compensation and resettlement of land acquisition for major construction projects,and strive to meet land-lost farmers’ interest demand;(4) builds a sound communication and coordination mechanism for the land acquisition for key construction projects, as well as a management mechanism before, in and after event;(5) establishes and improves rural social security system, to develop a diversified security and resettlement system. In terms of social pension insurance system, rural-urban binary division status can be solved; in terms of medical security, we can build a sound rural cooperative medical system,and lease some land to compensate the rural cooperative medical system; in terms of peasant employment security, the government can give play to its service function and work with the social force to enhance vocational training for land-lost farmers, vigorously expand the employment channels for land-lost farmers,and instruct land-lost farmers to take up an occupation, to promote social harmony and stability, to lay a foundation for the smooth land expropriation for major construction projects and the commencement of construction, and meanwhile make an exploration for the smooth implementation of the land expropriation for other key construction projects in future, such as Jinan-Qingdao High-speed Rail, so as to provide referential experience for the improvement of land expropriation for the major construction projects in Shandong Province.
