The Research On Regulatory Capture In Drug Quality Regulation In China

From ancient times medicine has been playing an important role in saving the patients. The drug is special product related to people’s health and life safety, so the quality of the drug is related to people’s health and life safety. In recent years, problems of drug quality becomes the focus of concern of all parties in society. Harmful events like counterfeiter medicine of Qiqihar NO.2 pharmaceutical company and Shanxi vaccine shocked the society. At the same time, they revealed the regulatory capture problems of quality regulation of drugs in our country. An in-depth study on the status and the existing regulatory capture problems behind the quality regulation of drugs in China, has important practical significance to the deep-seated causes of problems of mining. Offering effective policy to solve the problem is also an important focal point.Firstly, this paper briefly introduces the summary of theoretical research on regulatory capture at home and abroad, and the summary of theoretical research on quality regulation of drugs at home and abroad; Secondly, expounds the status of China’s drug regulation, and the existing problems of regulatory capture in drug regulation; Then, in response to questions mentioned above, this paper explores the causes of regulatory capture problem in drug regulation by making the excess returns and illegal cost as influencing factors and constructing the dynamic game theory model.; Fourth, through the introduction of USA and Japan’s experience of drug quality regulation, this paper draws on the enlightenment of the quality regulation of drugs in our country; Finally, with the analysis results of game model, and the enlightenment of developed countries’ experience of drug quality regulation, this paper puts forward specific prevention countermeasures according to the problems of drug regulation capture quality regulation.
