Preperty Rights To Executive Powers:The Story Of A Forest Dispute

In this paper, Anhui W village pipeline land conflict is a case study of the land-selling behaviors in the process of urbanization. Through the course of the pipeline land clashes detailed study, the author found that the clash was quite different from other "peasant land rights" events:Distinguishing from the land conflict in general "land-protecting" and "landing rights" events which caused the conflict, W village’s farmers considered the issue is that land acquisition range’ too small’, asking the town government to expropriate the whole land of the village. So,we can find out that the pipeline land conflict event in the W village, the farmers had the positive altitude to the government land acquisition and land-selling behaviors.That,is quite different from the theory of "resistant policy",which argues the totally adversed performance. Food and lands are the most essential concern to the most our people. However,with the process of the urbanization, farmers are beginning to take the initiative to require land acquisition action which subverts the traditional image of farmers, that generates a significant impact on the development. In this article,standing the standpoint of the farmers,regarding the pipeline land event selection as a starting point, combining with the local farmers’ reality and business expropriation compensation standard, I make an effort to examine the process of the event in details and the selection of farmers, in order to study the behavior of the farmers,to realize the behavior logic and motivation deeply.Through the course of pipeline land events in details,I have found that in order to "entirely takeover",the villagers held village representatives spontaneously, and took collective action, until the town government used administrative powers to complete the land acquisition work. From the beginning to the end, the interest demands of the villagers are the same:the realization of land-selling entirely. In this paper, through in-depth studies suggest that the farmers’behavior of land-selling is generated by a number of comprehensive reasons. First, the high land acquisition compensation is a direct element of the farmers’ land-selling. Secondly, the land does not make money is the underlying causes of the situation. Thirdly, China’s long-established constitution which demanding the separation of land ownership and use rights, farmers have no land ownership,It is difficult for lasting for a long time, which is an important reason for the farmers land-selling. Finally, with the development of the times and society, the changes of the value of land are the underlying causes of land-selling. Through in-depth study of the behavior of the land to the farmers land-selling, I believe that the behavior that farmers sell the land and settle in the city meets the "urbanization strategy".Nevertheless,we also have to watch out for the negative influence on the country and society of the land-selling behaviors.
