The Research Of Protect Migrant Workers Labor Rights’ Security Police

China is now undergoing social transformation. As the industrialization is growing, a large number of rural people come into cities. Their entering brings new labor force for the development of urban economy with a lot of problems. One of these problems is that their identities will not be admitted during quite a long time as the traditional system can not accept them. Migrant workers as a special group in the social construction in China, the discussion of their labor rights and interests maintenance has been putting a lot of emphasis on by both academic theories and practice communities. As a result, continuous reforms and improvement of relevant rules and regulations have become a private objective to maintain the socialist market economy.At present, the government has formulated a series of policies to protect the legitimate rights and interests of migrant workers. However, there are still shortcomings of the policy in the aspects of policy setting, policy decision, policy implementation and policy evaluation.The policy setting problem is mainly about the absence of national legislation for migrant workers, the lack of social insurance to protect the interests of migrant workers, the dis-unified standards between migrant workers and other workers. While the policy decision problem is mainly embodied in the lack of participant diversification in decision-making, also the imperfection of risk prediction capacity and the decision-making procedure. The problem of policy implementation is the authorities from different levels only care about their own interests when the carry out the policy, and also there is not effective monitoring during the implementation stage. moreover the power and responsibility is not even. The unawareness of the importance of evaluation causes the problem of policy assessment. Also the defective of evaluation and feedback system, the lack of relevant supporting laws and regulations has intensified the problem.Migrant workers labor rights and interests maintenance requires joint participation, cooperation and promotion. But for modern countries, government and policy should shoulder the main irresponsibility to protect the migrant workers’ interests. Aiming at the problems existing in present stage, the following aspects could be optimized to protect the labor rights of migrant workers:policy setting optimize the value orientation and relevant policies; policy decision improve the participant diversification in policy-making, improve the feasibility demonstration of the main decision-making, enhance the capability of decision makers and improve the decision-making procedure,optimize the quality aspects of policy improvement; policy implementation perfect execution mechanism,make the responsibilities clear,optimize supervision while execute the policy; policy evaluation the implementation of the policy from the policy feedback and evaluation from diversified assessment methods and promote the development of independent evaluation organization, form systematic evaluation procedure and let the public know the evaluation results, construct the feedback channels and diversify the feedback form.
