Research On The Problem Of Rural Construction Land Ownership Registration In Tengzhou City

Countryside construction is a fundamental problem of China’s reform and development, and the land issue is an important part of it. Rural construction land ownership registration certification is an important foundation to solve the problem of rural land. It is urgently needed to solve the problem that how to break the bottleneck of land system and improve the rural construction land system. Then according to the basic situation in Tengzhou,it interviews, investigates and collects basic information about rural construction land, and summarizes the problems of registration certification. Starting from the problems, it puts forward rationalization proposals from law and institutional level to make sure the registration can be granted as much as possible. What’s more, it promotes the transfer of rural construction land use right and homestead, endows the equal rights for collective-owned land in the rural areas and state-owned land in the urban areas, exercises the rights of ownership, use, disposition and earning, and protects farmers’ land property rights.Chapter Two is theoretical preparation for the research, including the general theories of land ownership, collective land, rural construction land, property rights theory and land registration. In this part, the paper briefly elaborates the development of rural construction land ownership registration certification. Then it analyzes the significance. In Chapter Three, it elaborates the country fundamental condition in Tengzhou, type composition and distribution of owners of land from practicality, the range, the main approach, the main achievements and the process and methods of rural construction land registration. In Chapter Four, it mainly analyzes the problems such as the empty location of the subject, the limitation of object and incomplete powers and functions, cadastral survey difficulties and funds guarantee. In Chapter Five, it putsforward rationalization proposals such as making clear the subject of ownership and use right of rural construction land, defining the object of ownership and establishing, improving the security system for powers, use power, cadastral survey and cadastral management. Furthermore, it provides practice foundation for the exploration and innovation of rural construction land ownership registration certification system.
