Research To The Problems Of Rural Land Contractual Management Right Transfer In Yuqing, Wenzhou

Land is the vital means of production of the countryside, foundation of the agricultural development, the basic dependence of farmers’ life. Implementation of the family-contract responsibility system, has separated the management right from property of land, energized the peasants for production and management, released and activated the rural productive forces, and promoted the development of agriculture and rural economy. However, after thirty years of development, scattered rural management also had many problems, became increasingly difficult to adapt to the development of marketization and industrialization of current agriculture. With the structural adjustment of agricultural industry, the development of the secondary and tertiary industries and the transfer of rural labor, rural land circulation began and accelerated. At the beginning, the peasants spontaneously subcontract the sporadic land, later the government launched, guided and promoted the land circulation. However, the rural land circulation in China is in the transition of development, we need further research on the circulation of rural land contractual management right, with a view to solve the problem effectively, and promote the rural development.This paper are based on the detailed literature, fact investigation, and field survey, with the process of "raising-analyzing-solving the problem" as the overall layout, with the foundation of research by the domestic and foreign experts about the circulation of the rural land contract management right, with the guideline of rent theory and property right theory, by the example of circulation of the rural land contracted management right in Yueqing city, mainly introduces the present situation of the circulation work, the major form, the characteristics and the method of government in promoting the practice of land transfer, and analyzes the current problems and put forward the corresponding countermeasures and suggestions.In recent years, Yueqing city takes market-oriented economy as guideline, on the basis of stable family contract management, adhering to the principle of "lawful, voluntary, profitable" and "clarifying ownership, stabilizing contracting right, stimulating use right", through various forms such as subcontract, lease, transfer, exchange, stock partnership to push circulation of the rural land contracted management right, accelerate the adjustment of agricultural industrial structure, promote agricultural efficiency and increases farmers’ income. However, Yueqing are still faced with many difficulties in practice in the circulation, deeply seeing, the current land circulation still has deep obstacles in concept, system and interests.In summary, the main problems focuses on these aspects as follows: the regional development of land circulation is unbalanced; the cognition of importance of land circulation is inadequate; the subject’s right of contracted management right circulation is restricted; scattered land distribution results in unobvious scale merit; transfer mechanism is unsound, policies measures are imperfect; circulation procedure is unnormative. To solve these problems, on the basis of studying the experience of domestic advanced areas, from the perspective of government management, the author thinks that to facilitate the circulation of rural land contracted management right in Yueqing city, there are several countermeasures and suggestions as follows:intensify publicity, upgrade understanding; perfect service mechanism for land circulation management; intensify policy support; foster the subject of rural land circulation; explore and optimize circulation form and so on.
