The Protection Issues Research About Intellectual Property In China-ASEAN FTA

China and ASEAN has built the China-ASEAN free trade area in 2010.They have signed the "People’s Republic of China and the ASEAN Framework Agreement on Comprehensive Economic Cooperation", "Trade in Goods Agreement", "Agreement on Trade in Services" and "Investment Agreement" in 2002,2004,2007 and 2009 respectively and have agreed to implement a comprehensive tariff reduction each other, so that China and ASEAN has a "golden decade" of economic and trade relations. In the meanwhile, the communication between China and ASEAN has become increasingly frequent, which is relate to intellectual property in trade, commerce, investment and goods. At the same time, the intellectual property disputes between China and ASEAN is increasing. Therefore, the provisions about intellectual property dispute can be changed only by relying on negotiation which is hold by the China-ASEAN free trade area.The main content of this paper is divided into four parts.The first part From the background of China-ASEAN FTA’s intellectual property protection. Describe the content of China-ASEAN FTA in the protection of intellectual property briefly. It laid the foundation for the following about the detailed analysis of China-ASEAN FTA Intellectual Property Protection problems, reasons and measures to improve.The second part introduce briefly analyzed the four problems in detail about the protection of intellectual property in China ASEAN Free Trade Agreement and analyzes the causes of these problems.By the comparative study of FTA China has signed with other countries in the intellectual property protection systems in the third part of this paper, We put forward by drawing on the experience of China and other countries in the FTA intellectual property protection at the present stage.The last part of the paper with upgrading the negotiations China-ASEAN Free Trade Area issues such as intellectual property to a new higher standards of progress in this path to this topic. He make a suggestion of how to improve the protection of intellectual property of the China-ASEAN FTA and put forward my own thinking and views on the improvement and future development trends of the problem.
