Research On Risks And Preventive Measures For Demand Guarantees In International Trade

With the improvement of the rapid development of China’s economy and the global economy, international trade and now is showing extraordinary development trend. In this context, are trying to carry out trade between countries, foreign trade has become an important part of international exchanges and economic development. Some multinational companies but also plays a very important role in international trade, under the investment and development of these enterprises, increasing volume of international trade, effectively promote the development of national trade. However, the increase in trade volume at the same time, trading parties must also take greater risks. And in this context, resulting in a very flexible way of bank credit guarantees-a demand guarantee. This form of guarantee can effectively guarantee the safety of international trade to a certain extent, reduce some risks in trade exchanges. However, this approach still many problems to the effective implementation of trade brought a certain impact. Based on this, to demand guarantees on the application of research to explore the risk of the application process for its existence, and then to find effective solutions to actively reduce the likelihood of the risk occurring, and thus the development of international trade play a positive role in promoting.The study is divided into six chapters. The first chapter of the background and significance of this paper discussed the writing on the domestic and foreign demand guarantees on research carried out research based dissertation writing and lay a good foundation.The second chapter is the guarantee of the theory provides an overview of the concept of demand guarantees, property, and other types of produce as well as the structure of the content of the research to provide theoretical support for the next study.The third chapter is the guarantee of the applicable legal requirements were analyzed separately from the application of relevant international conventions, as well as the application of the relevant international conventions applicable to the three aspects of domestic law were discussed.Chapter IV demand guarantee risk in international trade were discussed, analyzed risks such as contract is invalid or termination, or default of contract.Chapter V of the demand guarantee and improve the risk prevention measures in international trade were studied.
