The Research Of Improving Chinese Legislation On Rural Left-Behind Elderly

In recent years, Chinese economic is developing rapidly. With the progress of urbanization and huge demands on workforce, a large number of farmers moving from rural to urban. We shouldn’t forget that enormous sacrifices are made by rural left-behind elderly, their children leave far from home to work in city, the rural left-behind elderly have to make money themselves and live in poverty. Relative to the cites, the level of productivity in rural is lower and the economic fundamentals of the rural are weaker. Farmers are lack of legal consciousness. In a word, the guarantee problems of rural left-behind elderly at this stage are highlighted. Therefore, whether basing on the protection of human rights or the necessary of national entire system of social security, we must focus on protecting and giving relief to rural left-behind elderly. They are vulnerable groups. If rural labors entering city is a general trend, establishing and improving the rural social security system for the rural left-behind elderly is inevitable.It is beginning with the concept of rural left-behind elderly in this article, it introduces the present situation of the rural left-behind elderly. The second part discusses the three most important things about the social security system in China. They are social insurance, social assistance and social welfare. By pointing out some problems of Chinese social security system with using data, we can know what is really missing in these issues. In the final part, I will put forward some legislative proposals to solve problems which are mentioned in the second part.
