Study On Legal System Of Internal Distributing Collective Operating Construction Land Circulation Earnings

The problem of collective operating construction land circulating in market and its earnings distribution is a recent focus of attention of state and society. Although the reform experimentation of collective operating construction land circulation is systematically carried out, the problems exposed of circulation earnings distribution need to solve. To this end, the author selected " legal system of internal distributing collective operating construction land’s circulation earnings " as the research content,and adopted the structure of "total- points", used train of thought of "ask questions,analyze and solve problems". This article is divided into four chapters altogether.The first chapter is about basic theory of internal distribution of collective operating construction land’s circulation earnings. In this chapter, starting from analyzing the related concept, the author analyzes the content of internal distribution of collective operating construction land’s circulation earnings and its theoretical basis.The second chapter is about the background system and pilot study of internal distribution of collective operating construction land’s circulation earnings. This chapter firstly introduces the background system of internal distribution of collective operating construction land’s circulation earnings. And then investigates the reform pilot area of six typical for reference.The third chapter is about existing problems for internal distribution of collective operating construction land’s circulation earnings. This chapter is around the subject,way and procedures of internal distribution, which are divided into three sections in detail and analyzed their respective status quo and problems.The forth chapter is about system improvement of internal distributing collective operating construction land’s circulation earnings. In this chapter, the author respectively puts forward countermeasures and suggestions for the existing problems in the subject, way and procedures of internal distribution, and designs the basic principles and relevant supporting measures of internal distributing collective operating construction land’s circulation earnings, in order to ensure the complete system improvement of internal distributing collective operating construction land’s circulation earnings.The innovation of this article lies in: One is the breakthrough on the traditional definition of t collective operating construction land, instead, the author expands its connotation and denotation. Two is to abandon the traditional distribution way according to work, need and factor of production, instead, the author puts forward new ideas about distributing according to the capability. As for the reason why the author holds these two new ideas, there will be discussed in this paper.
