Analysis Of The Roles Of Supervision By Media Public Opinion During The Environmental Public Litigations

With the implement of environmental protection act on January 1,2015,the folk force was brought into the mechanism of environmental management gradually,the public environmental litigation system was set up,and these measures become the powerful safeguard of environmental protection in our country.Ecological environmental problems become more and more severe,public environmental litigation plays an important role in the process of environmental protection,and it is also the hotspot in the fields of laws and environmental protection studies.Although there is about 400 courts related to environmental protection suits,the implement of the public environmental litigation system is difficult in our country.The great influence of cases,the wide range of cases,the different judgments standard,the limits of plaintiff qualification and high case cost are reasons why environmental litigations are so rare in our country.Practices indicate that supervision by media public opinion can exert a huge effect in the environmental public litigations.Firstly,the public is always unfamiliar with the environmental public litigations,cases were reported by media make the public believe that environmental problems can be solved by litigations.Secondly,supervision by media can exert certain effects on cases,and render encouragement to plaintiffs.Without any wonder,the involvement of media can put forward to the environmental public litigations.In this study,with the discussion of the necessity of environmental public litigations as the bases,we investigate the development of current environmental public litigations in our country,the effects and roles of media on the process of legislations and the diffusion function of media along the environmental public litigations by the methods of literature research,cases analyses and media reports related to environmental litigations in recent years.
