Pollution Of The Environment Legal System Of Third Party Governance Research

As an important legal system of environmental governance, the legal system of the third-party governance for environmental pollution is carried out by China. Building the third-party governance mechanism for environmental pollution has become the new power of environmental governance and ecological restoration. The legal system of the third-party governance is the important way to promote the professionalization and industrialization of environmental governance. This new method of environmental governance is the sublimation for the principle of “damage liability”. Therefore, governing environmental pollution by the mode of the third-party governance has become a new choice to solve the problems of environmental pollution improvement with traditional mode.The third-party governance system belongs to a new mode for environmental pollution in China, which can be called as “damage liability, professional governance”. The third-party governance system was not founded by China. In developed countries like European countries, America and Japan, the third-party governance for pollution has already been applied widely, which obtained good practical results. Generalizing and using the law and regulation of the third-party governance accord with the development tendency of international environmental service industry. However, there are still many problems to be solved in the process of generalizing, combining the specific development situation of China at the present stage. For example, the law system is bounded, the main responsibilities need to be clarified, the market access and exit mechanism are not perfect enough, the companies of the third-party governance have financing obstacle, etc.. These problems need to be supported and guaranteed by relevant policies and systems to promote the generalization of the third-party governance mode. Aiming at the concrete problems in China at the present stage, this thesis analyzes from several aspects of the third party governance body specialized environmental pollution, and environmental pollution prevention and control of main body right standardization, tax incentives and financing strategy, improve the environmental pollution by a third party credit evaluation mechanism, promote the environmental risk insurance system. Its purpose is to establish the omnibearing facilitory mechanism and system, promote the third-party governance system efficiently, solve the difficulties of environmental governance, and release the environmental pressure in China.
