Research On Government Supervision In Third-party Governance Of Environmental Pollution

The governance of environment which works as a system needs multi-party cooperation.The government plays an indispensable role in promoting the development of third-party governance of environmental pollution.We need to actively respond to the incompleteness of the third-party governance market mechanism,utilize the principle of multi-central governance as the starting point,take realistic issues as a starting point,carefully analyze the loopholes in environmental supervision,and combine administrative measures,such as policy support,legal regulation approaches,and professional governance methods.It is also important to improve the environmental supervision system and related implementation rules,and give full play to its supervisory functions.Only in this way we will effectively promote the development and application of environmental pollution third-party governance,and make it play a practical role in solving China's increasingly serious environmental problems.This article,which mainly consists of three parts,discusses the issue of government supervision in third-party governance of environmental pollution.The first part analyzes the necessity and practical significance of the government to supervise the third-party environmental pollution.As for first,the concept of third party governance and the governance model,this paper analyzes the relative legal relationship to illustrate that the pattern in our country is still in the preliminary stage of development,and needs more government guidance and regulation;Secondly,it points out the legitimacy of government as the subject of supervision from the perspective of theory and institutional tradition.Second,this paper proves the legitimacy for government works as primary superintendent in the aspects of theories and system tradition.The second part analyzes the government regulatory status in the third-party environmental governance,introduces the government environmental standard,organization and system architecture of the regulatory system,points out the role and the responsibility of government in the third-party governance,and illustrates the problems in 'real regulation.The third part is mainly about the problems which are mentioned in the second part,and puts forward some feasible suggestions in the methods of improving the structure,improving the regulation and monitoring the contracts,such as Improving the independence and authority of environmental regulatory,establishing a unified system of environmental monitoring data,Strengthening the supervision of cont.ractual behavior between both sides of pollution discharge and governance,etc.
