The Causes Of Environmental Group Events And The Corresponding Legal Countermeasures

In recent years,the rapid economic development in China,as it is,the pressure on the environment increases,obstacles to environmental problems in the development of the national economy become increasingly prominent.There have been more and more mass incidents that have erupted due to environmental problems.This not only affects the long-term stable development of China's economy,also had an impact on social stability.This exposed the legal mechanism for resolving of environmental group events in our country is not perfect,the rule of law posed a severe challenge to China,must be taken seriously.Therefore,it is necessary to analyze,from a legal perspective of the corresponding countermeasures.All in all,discovered this phenomenon and focused analysis of the causes of,and finally to legal control is the idea of writing the article.The text is divided into three parts,as follows:First,from a macro point,based on typical cases of environmental group events through case shows,determine trends,summarized its reasons,legal measures.Among them,a variety of environmental causes of group events,surface,there are deeper reasons.Government actions,ideas,rule of law and litigation of public opinion analysis of the various causes of environmental group events happening in our country at present stage.Both specimens and to propose a solution,the environmental values into the enterprise,ensuring public participation rights,improvement of environmental legislation,improve environmental behaviour to achieve environmental protection requirements and achieve coordinated development of economy and environment.Second,from a specific point,this paper is divided into three parts:The first part is the present situation and development trend of environmental group events,by presenting two cases leads to the topic of this article,and then from the number,area,types,four judgments of the situation and its development trends;The second part is the analysis of causes of environmental group events,mainly from six aspects:Among them,the first two macro-analysis,four for detailed analysis.First,excessive pursuit of economic achievements of local governments;Second,change the social contradictions exposed;Third,administrative acts of local governments is not standard(EIA implementation of systems are not in place,illegal state prior to examination,procedure,system of accountability);Four is the legal mechanism of the quest is not perfect(lack of information,public participation and remedy legal mechanisms are not perfect);Five is the construction of rule by law in the environmental field(environmental law system is not perfect,some people sense of rule by law,and legal punishment is inadequate);Six is the lack of corporate responsibility,the Government early warning mechanism is not perfect.Part ?legal countermeasures in order to solve the problem of environmental group events,mainly discussed from three aspects:One is the national level:Improve the environmental legal system(Strengthening the construction of environmental legal system,increased pollution penalties);Second,local level:Sound environmental legal accountability(Establishment of environmental information sharing mechanisms,implementing a network management system,improve accountability mechanism for environmental impact assessment);Third,the level of the general public:Strengthening the consciousness of environment law(Right to broaden the public's participation,expansion of environmental public interest litigation to enhance public awareness of the rule of law).
