Research On Legal Problems Of Environmental Protection In Marine Oilfield Mining

The twenty-first century has undoubtedly become an ocean century.The rapid development of industrial society for decades has made land resources become near the depletion.The world has to look into the ocean,which is rich in oil resources in the huge aera.With the frequent increase in offshore oil exploration activities,the immature offshore oil extraction technology has caused the marine ecological environment to be damaged heavily.In order to standardize the exploitation of offshore oilfields,it is necessary to improve the environmental protection system in the process of exploration and development of marine oilfields.Based on the analysis of the current situation of the legal regulation of marine oilfield mining environmental protection at home and abroad,the author tries to draws lessons from the successful experience of foreign marine governance,combine it with the current situation of China's marine governance,and then offers advice and suggestionssets to set out the special legislation for the exploitation of environmental protection of marine oilfields in China.The first part of this paper redefines the concept of offshore oil field and makes a necessary description of the present situation of mining,laying the foundation for the development of the whole discussion.The second part explains the advanced legislative experience of the international treaties and the marine power on the oil pollution damage and the status quo of legislation about China's marine oilfield mining on environmental protection.The third part analyzes the shortcomings of the international treaty in legislation and the shortcomings of China's environmental protection legislation in the process of exploitation of marine oilfields,so as to put forward some legal suggestions later.The fourth part puts forward the measures that should be improved in the process of environmental protection legislation while exploitating marine oil field from domestic and foreign legislation,law enforcement and judicial point of view.The innovative points in the thesis are as follows:1.In the country,we will take the lead in discussing the exploration of marine oilfields from the perspective of environmental protection.2.On the basis of comparing international law and the advanced system of marine environmental protection in the world law,daw lessons from international and national legislation experience,and strive to systematically build China's legal system of offshore oil exploration and environmental protection.3,the training of legal personnel should also be taken into account while improving the legal system of marine oil exploration environmental protection.
