Research On The State Obligation Of Environmental Rights From The Perspective Of Human Rights

The value of human rights lies mainly in the positive response to the social and objective world of human existence and development.Environment,as the most important material factor for human survival and development,is an integral part of human rights.At the same time,as a new type of human environmental rights,began to appear in the national civil rights pedigree,so,the environment right as a citizen to pursue their own survival and development of the value of the rights,due to the existence of the indispensable,and determine its basic rights of property.However,for the environmental rights of citizens,not only need to protect the country in the abstract,more important is to give positive as the concrete practice,through the natural right to actual right orientation,ensuring the environmental right of the final point of the main obligations.The obligation of reshaping the main body of the protection of environmental right theory,which puts forward higher requirements,to assume more important environmental responsibility of the country however,limited to the lack of level of environmental right system,as a guarantee of environmental rights obligations,the state for environmental rights of citizens can not play its proper security function.The progress and development of China’s environmental rights cause are obvious to all.However,due to the unstable social development,the construction of democracy and the rule of law started late,and there are still many unsatisfactory aspects of China’s environmental rights protection.Part of the protection of the right to the environment depends on the active participation of society and individuals,butit relies mainly on the state and the rule of law.As the most important subject of environmental rights protection,the state has the obligation of respect,protection,promotion and protection.In recent years,with the extensive attention of the people on the environment,more and more scholars dedicated to the study of the national obligation to protect the environmental rights,from different perspectives,and to explore the in-depth analysis on the relationship between the national obligations and environmental rights.With keen interest,the author from the perspective of human rights,national obligations for the protection of our environment right of reality to find out the environmental rights protection system in the country,summarizes the environmental right protection deficiencies and shortcomings,to further improve the environment right state obligation fulfillment system to provide reference.
