The Research On Legal Countermeasures For Integration Of Urban And Rural Environmental Protection In China

Over the past 30 years and more since reform and opening-up,China has made great achievement in economy development.But the environmental costs are also shocking.Governments at all levels have been conducting environmental governance,and achieved some results.But it didn't fundamentally solve the environmental pollution problems.The reason mainly includes the following two aspects.On the one hand,under the "City Centre" ideas,governments take much environmental governance investment funds in urban and less in rural.On the other hand,the improvement of urban environmental protection standards and the needs of the development of rural economy,resulting in a large number of urban industrial pollution sources to rural areas.Memory beautiful scene is declining in the countryside.In the same time,the deterioration of rural environment will in turn affect the urban environment.As the relationship between urban and rural areas is more and more close,we should break the urban-rural dual structure and take the urban-rural integration environmental governance.This paper on the basis of the integration of urban-rural environmental protection and environmental governance related theory and successful experience of the United States give some suggestions about the development of the integration of urban-rural environmental governance in law.The body of the article includes six parts.The first part is the introduction.This part narrates the research background,significance,domestic and foreign research results,research ideas and research methods and technology.The second part expounds the integration of urban-rural environmental protection theory.First of all,define the concept of the integration of urban-rural environmental protection.Then,elaborated the environmental justice theory,urban-rural coordination theory and cooperative governance theory.This part serves as a theoretical basis for the following discussion.The third part illustrates the effectiveness of the integration of urban-rural environmental protection development in our country from the theoretical and empirical view.Taking Zhang Jia Gang,Chang Shu and You Xian as an example,this paper makes an empirical study on the collaborative governance of urban-rural environment.The forth part is to discuss and analysis the problems and reasons of the integration of urban-rural environmental protection development in our country.According to the article,due to the environmental governance idea lag behind,environmental law is imperfect,imbalance of financial input and imperfect management system wait for a reason,caused the unbalanced urban-rural development and urban-rural environmental protection gap is further widening.The fifth part introduces the experience of the legal system construction of urban and rural environmental protection integration in the United States.Think that the United States have accumulated much experience in the strengthen legislation to develop sustainable agriculture,rural environmental protection and rural environment pollution control services and so on,and their experience certainly merits our reference and study.The last part from consolidate the correct legislative idea,perfecting legal system of environmental management,increase financial investment and improve the system of environmental governance system of our country to further improve the integration of urban-rural environmental protection laws and regulations construction.
