Study On The Legal System Of Soil Pollution Prevention And Control In China

With the continuous development of industrialization,modernization and urbanization,the overall situation of China's economy has made great progress,but the pollution problem,especially the agricultural land pollution problem has become increasingly serious.At present,China's agricultural land pollution mainly lies in agricultural non-point source pollution,solid waste,upstream(source)pollution caused by waste water into the farmland.Compared with urban land,beach and other places,agricultural land management is more difficult.Once the pollution is caused,it is very easy to lead to the declining of food production and quality,resulting in the entire food chain pollution and the decline of residential health,endangering the development of national economy.This prompted us to face the current agricultural land pollution problems,to analyze reasons of China's agricultural land pollution,to understand the relationship between soil pollution control and existing environmental governance,and then add the existing legal system loopholes in agricultural land pollution,so as to carry out its comprehensive governance.At present,there are many reasons for the soil pollution of agricultural land in China,but the main problem is that China lacks the perfect legislation system of soil pollution in agricultural land,as well as the existing soil land environmental monitoring system can not play its role effectively,the government regulation is not strict and out of date.The soil environment grading management system is unreasonable in use of pesticides and fertilizers.As to this,although there are some environmental governance legislation in China,but because there is not a standard "soil pollution prevention and control law",agricultural land pollution control and existing environmental management can not be seamlessly connected with each other,therefore the difficulty of China's agricultural land pollution prevention and control has greatly increased.In addition,the relevant supporting system is not perfect,the government's supervision and many other factors are the causes of this problem.Therefore,in order to solve the problem of soil pollution in agricultural land,China needs to establish a special system of soil pollution prevention and control according to the actual situation,establish the corresponding agricultural subsidy mechanism and establish other supporting systems.In addition,according to the "Soil pollution prevention action plan" which explains the development of relevant laws and regulations,the local government should learn from foreign experience,to carry out comprehensive prevention and control measures.Based on the analysis of the causes of agricultural land pollution,the existing management system and the defects of legislation,the experience of developed countries and the construction of future agricultural land control system in China,this paper puts forward some suggestions and countermeasures to soil management.
