Study On The Legal Prevention And Control Of Industrial Pollution Transfer To Rural Areas Under The Background Of Urban-rural Integration

With the acceleration of the process of urban and rural integration,great changes have taken place in China's economic structure and mode of development.Under the dual pressure of urban environmental control and environmental costs,urban pollution industry has moved to rural areas more frequently,and rural environmental pollution getting worse.Affected by the dual economic structure of urban and rural areas in China,there is a relatively independent system of environmental protection legal system in urban and rural areas.Thus,it is difficult to prevent and control industrial pollution from being transferred to rural areas.Based on the background of urban and rural integration,the transfer of pollution sources in the process of urban industrial transfer to rural areas is chosen as the research object in this paper.It is necessary to break the binary division of urban and rural environmental protection from the design of legal system,to achieve the ultimate goal of protecting the rural environment and the integration of urban and rural social and economical development.This paper mainly conducts the following research:Firstly,the survey of general situation of and industrial pollution to rural areas in the context of urban and rural integration.In the context of urban and rural integration,a large number of polluting industries transferred to rural areas frequently have caused a coexist situation of rural agricultural pollution and industrial pollution,so problems like rural soil pollution,water pollution,air pollution and other environmental problems are continually intensifying together with noise pollution,electromagnetic radiation pollution and other new environmental problems continually highlight.The more and more serious rural environmental pollution hazards continue to damage the farmers' environmental rights and interests.Secondly,the legal system dilemma of pollution prevention and control to rural areas under the background of urban and rural integration.At present,the legal system of pollution prevention and protection of rural environment in our country is not perfect,and there are many legal difficulties such as the serious lag of rural environmental planning,the low standard of rural environmental access,the serious shortage of rural environmental protection and protection of farmers' environmental rights and interests.Finally,legal countermeasures for preventing and controlling industrial pollution transfer to rural areas under the background of urban rural integration.In view of the transfer of urban industries to rural areas has become an inevitable trend of the development of urban and rural integration,this paper attempts to break the segmentation of urban and rural environmental protection from the point of legal system design.In addition,to put forward better legal measures on rural environmental planning,environmental access,environmental protection and farmers' rights protection,for the purposes of protecting the rural environment and the safety of farmers' personal property.In this paper,through the design of urban and rural integration legal system for the practice of urban and rural economic development together with the prevention and control of industrial pollution transferred to rural,this paper provides a strong guarantee for the promotion of urban and rural integration theory which also has an important theoretical significance on how to improve the supply system of environmental protection legal system in the integration of urban and rural.
