From the cultural concept put forward to the development of a system theory, it experienced a long study by ancient and modern Chinese and Western scholars. About the structure of the culture, the scholars have been divided into different angles. The material,the system and the spirit hierarchy theory is raised, through constantly development and improvement, gradually accepted by the scholars in the field of culture. Material culture to meet the most basic human survival needs(such as clothing, food, shelter, transportation)as the goal, is the sum of the material activities of people and their products Institutional culture of human social practice established in various social norms, social organizations,people(individual and organizational) rules of conduct. Cultural spirit is produced by human consciousness and social practice activities for a long time accumulated values,ways of thinking, it is the core part of the whole cultural system and a kind of cultural differences in the important sign of another culture.The court building provides the space carrier for the normal development of the judicial activities, it is the most intuitive way to show the culture of the court and the idea of the rule of law. However at present our country’s court construction exposes a lot of problems, causing a strong social reaction. The reason is the construction of the Court relevant norms, and lack of system is not perfect and ideas court building decision-makers deviation. In view of the important functions of the court building, it is necessary to hierarchy theory of cultural studies as a tool to carefully study the direction of the court building construction, the court buildings become an important pledge carrier for the idea of rule of law in China.
