Study For The Preference Of Contract Arrangement Of Engineering Project Client

At present,in our construction sector,there are still typical features of buyer market,with the leading position in the market,the clients have absolute advantages over the selection for contract templates,contract categories and contract conditions,and usually make stipulations that favor themselves in contract specific conditions arrangement and trade-offs,and transit some or all the risks in engineering projects to the contractors.In seriously competitive environment,even the contractors accept this unfair risk allocation structure,they would have defensive emotions and take opportunistic behaviors,or take negative attitude in achieving the engineering project targets,which lead to issues like poor engineering quality and various disputes,as well as potential high hidden cost,the prices paid for the hidden cost may exceed the value of issues two parties argue about.Therefore,it is necessary to study what contract terms or term content the clients tend to choose or stipulate.Bring the idea of preference to the selection of contract terms or the stipulation of terms content,and provide convenience for studying the client selection and arrangement for contract conditions.The selection and arrangement for contract conditions by clients is the specific embodiment of their preference for contract arrangement.The nature of client preference for contract arrangement is a contractual governance measure based on subjective tendency for the maximum of their own interests.The client preference for contract arrangement and contractual governance would impact the behaviors of contract participants.Properly integrate the rational preference with effective contractual governance mechanism is the goal that is pursued by studying the client preference of contract arrangement.According to the objectives of this study,the author has issued questionnaires for the personnel who conduct engineering management and relevant works,and conduct detailed statistical classification for the data collected through questionnaires.Form preference of contract arrangement analysis framework based on the client,contractor,public works,private projects or private works,and conduct sequential analysis for the questionnaire data.The results show that there are 5 categories of preference for contract arrangement;that the client and the contractor have 13 preference of contract arrangement which the tendency is much different even opposite.The results reveal that the client preference of contract arrangement directly impacts the attitude that the contractor performs the contract,and play an important part in the smooth implementation of contract.It is expected that the study for client preference of contract arrangement would provide references for the client in selecting contract terms or stipulating supplementary content while signing the contract.
