Study On Optimization Of Contract Governance In H High-speed Construction Project

With the rapid development of expressway construction projects,the problems of the contract participants in the process of contract implementation are emerging.In order to solve the problems in the process of highway construction and reduce the risks in the process of highway construction,scholars have explored new governance model in different fields.In fact,In implementation process of the project,project contract has become the core of construction project management,especially after the country has fully implemented the tending and bidding system,the contract has been the most popular aspect which the project owner and the contractors have concerned,both of them all hope that through appropriate contractual governance policies,not only to ensure the smooth implementation of the project,but also to protect their interests.Project contract management and contract governance are two different concepts,the former involves the specific operation process,while the latter focus on the construction of the project contract basis and the framework of the responsibility system.The article chooses H high speed construction project contract governance as the concrete research object,firstly introduced the research background and significance of the full text,summarized the theoretical research results of domestic and foreign scholars on contract management;on the basis of defining the connotation of project governance,contract governance and relationship governance,the paper refined the measurement and influencing factors of project contract governance,analyzed the relationship between project contract governance,contract management,project governance and relationship governance.Secondly,analyzed the current situation and the governance effect of H high-speed construction project,pointed out the problems in contract governance,such as the backward contract management level,the lack of contract execution,the low risk of contract risk management and the existence of moral hazard problem,revealed the reasons included imperfect contract management organization,unreachable engineering analysis,lack of rigorous contract management system and sound laws and regulations.Finally,the paper put forward the concrete improvement measures from internal,external and relationship governance,internal governance optimization measures included construct the organizational system of internal governance of contract,the “full project,full and the whole process "of the contract management system,the project contract internal governance evaluation system and project contract risk management system;external governance optimization measures included improving contract management laws and regulations,properly handling stakeholder relationships and improving contractual integrity system;contractual relationship governance optimization measures included the emphasis on project relationship governance and contract governance and relational governance complement each other.The research enriches the framework system of China’s construction project management theory and expands the application scope of contract management theory;help H high-speed construction project owners finds and solves the problems in the contract management,conducive to the smooth implementation of the project construction projects,reduce construction costs and risks,improve the economic benefits of construction projects.Above all,the conclusion of this paper has some guiding significance and reference value for the construction of expressway construction project contract management in other areas of our country.
