Today, along with the implementation of “the Going-out Policy” and “the Belt and Road Initiative”, more Chinese engineering contractors go oversea to search and develop new project market and to find new driver of growth. Compare with the market in Africa where our domestic contractors early entered, Malaysia, the largest trade partner of China in Southeast Asia has a far more advanced law and regulation system, economic and social environment, and engineering contracting market institutional system. Chinese contractors entered Malaysia not very early, but now because of the leaders of both countries frequently exchanged visits, the growing economic communication between China and ASEAN, and the launch of China-ASEAN High-speed Raillink, the amount of Chinese contractors in Malaysia tends to grow up faster than ever. Problems of variations and claims in the construction practice become popularly and widely happened, nevertheless we could hardly find research or discussions on the topic of the engineering market in Southeast Asia.Based on the collection and analysis on vast related foreign references and case analysis, together with the personal experience of the author in the management of SP tunnel project, this paper explained and analyzed the engineering contract system and theory in Malaysia and the variation and claim clauses of the related contract. Detailed introduction and analysis on the actual case and its important points of the variations and claims are presented. The common causes of the variations and claims in the projects that contracted by Chinese enterprises and the management organization structure, communication management, human resources management, contract and risk management are all explored and summarized.This article presents solutions and suggestions in the risk identification and response to the variation and claim management of Chinese contractors in Malaysia. This paper provides a new special study on the engineering contract management in Malaysia and enriches the study on the overseas project management to certain extent.
