Research On Current Development Situation Of Pharmaceutical Industry Based On Patent Analysis In Henan Province

With the advent and development of knowledge economy, the intellectual property rights in international economy and trade has played a very important position and role, having become the most valuable form of property. The patent system as the core of the intellectual property system, is the most effective way to protect invention, so it should be taken more seriously. Drug industry belongs to the knowledge intensive and high-tech industry, highly relying on science and technology, Its development especially needs the patent protection. Through understanding the patent situation of medicine industry in Henan province,the gap with developed areas and the contribution to the economic development of manufacture of medicines in Henan province,this study aims to explore reasonable suggestions to promote the patent development of medicine industry in Henan province,so as to enhance the competitiveness of the pharmaceutical enterprises in Henan province.At the same time, providing reference, consultation service and decision-making basis for relevant departments relating to intellectual property right in Henan province.In this paper, literature research, statistical analysis, patent analysis, literature metrology, and empirical analysis are used, taking the patent information of pharmaceutical industry since 1985 in Henan province as objects. First, using literature research to systematically and comprehensively understand and master the overview patent strategy of drug industry, so as to propose the research ideas. Second, through statistical analysis, based on the state intellectual property office and SOOPAT patent retrieval sites, search, collect and sort the patent information of pharmaceutical industry since 1985 in Henan province, to set up a database. Then, with the patent analysis and literature measurement, systematically analyzes the patent index form kinds of aspects, such as the patent application and grant, types of patent and IPC classification, regional distribution, state of the patent law, the patentee and patent technology on enterprise distribution. After that, with the aid of econometrical model, using EVIEWS8.0 statistical analysis software, select the related data of Henan province, to carry on linear regression analysis on drug patent output to the contribution of manufacture of medicines. At last, based on the results of analysis, we draw conclusions, and put forward corresponding suggestions.The results show that patent application and grant of pharmaceutical industry in Henan province present a rising trend as a whole. Up to January 31, 2016, the total number of drug patent applications and grant of Henan province is12319 and 2835, ranking the seventh in our country, the development situation is good. But drug patents authorized rate is low, and content of science and technology needs to improve. Invention patents occupies the absolute dominance, showing that the science and technology innovation ability is good. The technical fields are mainly concentrated in A61 K and A61 P. Invalid patents account for more than half. The medicine development in different regions is unbalanced, with Zhengzhou, Luoyang, Anyang, Puyang running in the front The number of patentee increased with each passing year, but the patentee structure is not reasonable, it lacks service- patentees. Production-study-research cooperation is poor; Patent cooperation rate is low; A large number of patent technology concentrate in the hands of individuals, so that the conversion rate of patent products is low. Pharmaceutical enterprise strength is relatively backward and overall competitiveness is poor. From the point of empirical analysis, drug patent applications especially invention patents applications have a significant impact on economic growth in Henan province. Pharmaceutical patent applications and invention patent applications increase every extra one percent, which can lead to about 1.144 and 1.140 percent for growth of manufacture of medicines in Henan province.Accordingly, this study put forward some countermeasures from the government and pharmaceu-tical enterprise to perfect patent development of medicine industry in Henan province. The government should perfect the relevant patent laws, creating a good legal environment for the patent development; Strengthen policy guidance, promoting the coordinated development among regions; Increase investment, encouraging innovative products and enhance the public patent protection consciousness, creating a good social atmosphere. The pharmaceutical companies should establish the consciousness of patent protection, attaching great importance to the protection of patent work; Rational use of patent information, carrying out the work of patent intelligence; Strengthen production-study-research cooperation, improving the conversion rate of patent technology and strengthen independent innovation ability, enhancing the competitiveness of enterprises.
