Patent system is the core of intellectual property protection system and the most effective way to protect and promote medical innovation.Nowadays,patent competition has become the focus of competition among pharmaceutical enterprises.This paper aimed to enhance the market competitiveness of pharmaceutical enterprises in Zhengzhou effectively,and promote it healthy development.At first,it based on relevant patent information,analyzed the development status quo of Zhengzhou's pharmaceutical patents.Then,the differences compared with the advanced level at home and abroad were found out.At last,the countermeasures to promote the development of pharmaceutical patents in Zhengzhou were discussed.In this paper,the research object was the patent application information of Zhengzhou pharmaceutical industry since the implementation of the patent law in 1985.And the research methods,such as literature metrology,literature research,statistical analysis and patent analysis and so on,were comprehensively used.The comparative analysis revealed the deficiencies in the pharmaceutical r&d and innovation ability of Zhengzhou at the present stage.In order to improve the competitiveness of Zhengzhou's pharmaceutical industry,pertinence constructive measures and suggestions were presented from the aspects of the government,enterprises,universities,scientific research institutions and individuals.It would also provide reference for the decision-making for the intellectual property management department and the innovation subject in Zhengzhou.The results showed that the application of invention patent played a dominant role in the patent application of Zhengzhou pharmaceutical industry.The distribution structure of patent application type was relatively reasonable,and the scientific research and innovation ability was well.The technical content was mainly concentrated in A61K(medical,dental or dressing products)and A61P(the therapeutic activity of compounds or pharmaceutical preparations).Among the major cities in China,Zhengzhou ranked the tenth in the number of the pharmaceutical industry patent applications.Overall,the patent applications presented a growth tendency,and showed a good development trend.The subjects of innovation also played more and more attention to the intellectual property rights.And the transfer of patent rights showed a rising trend.However,the gap between Zhengzhou and developed cities at home and abroad in the pharmaceutical industry still existed.Prominent problems included low quality of patent application,low amount of patent authorization,high number of invalid patents,and a large number of patent applications owned by individuals.The pharmaceutical and its related institutions were insufficient research and development capability,repeated investment in scientific research,low technology,and the poor whole competitiveness.In view of this,the government should play a leading role,increase funding and incentives,improve the legal system,promote balanced development and enhance public awareness of patents,create a good atmosphere for innovation.Enterprises should improve patent early warning,improve innovation ability,establish patent awareness,attach importance to intellectual property protection,improve patent management system,strengthen the industry-university-institue,improve the conversion rate of patent technology,and enhance independent innovation ability and the competitiveness of enterprises.Universities,scientific research institutions and individuals should promote cooperation,improve achievement transformation,enhance patent applicants' awareness of self-owned patent protection,and pay more attention to seek cooperation with enterprises.In addition,the government should act as a bridge between enterprises,universities,scientific research institutions and individuals,which would provide a platform for intellectual property exchanges and promote mutual cooperation.
