The Problem And Solution Exploration Of Doctor-patient Dispute In Chinese Medical Institutions From The Perspective Of Treatment Theory

In recent years,the rapid growth of medical disputes in our country has gained more and more attention of government and society.In the "two sessions(NPC &CPPCC)" in 2004,there are more than 90 suggestions and proposals which focus on the dealing of doctor-patient dispute issues.It is not only the increasing quantity of medical disputes,but also a number of medical disputes has transformed into violent conflicts.In May 2016,a dentist in Guangdong was slashed more than 30 times and finally died.In the same year,a respiratory physician in Jiangxi was attacked by mass brawl when he announced the patient died.All of these malignant affairs are the best cases.When patients' rights failed to be protected,they would turn to "medical alarm" even violence.In order to get the self-prevention,the hospital also takes various means of antagonism,which leads to an increasingly tense on the doctor-patient relationship.There is no doubt that the social negative influence is extremely bad.Therefore,how to deal with the medical disputes fairly and effectively has become the focus of social attention from all walks of life.From the perspective of collaborative governance,this article summarized the present situation and the characteristics of medical disputes and dug deeper into its social harm and the root of the problems through literature research,comparison and analysis,the methods of system analysis.Then the advantages and limitations of a single main governance would be analysis at great length.Finally from the aspects of improving individual subject governance mode,strengthening the coordination linkage,perfecting the safeguard mechanism and improving the supervision of public opinion,the collaborative governance plural opinion would be put forward.Through researches and investigation,it found that the main problems of medical disputes in our country are mainly described as follows: the low degree of doctor-patient trust on both sides,the increasing number and scale,endless irrational illegal right safeguard,fast spreading bad public opinion,high degree of nonstandard mediation mediation.Through careful analysis,the writer found that the roots of these problems are caused from the reasons of many aspects,including insufficient government investment,the imbalance of the resources,uncompleted system factors as well as lack of communication,poor management,low quality education and improvement of safeguarding right consciousness,high expectation on treatment,and false propaganda and misleading the public and other social factors.Then the perspectives of depth analysis on the advantages and disadvantages of a single main governance on the doctor-patient disputes would be presented Such as health department possesses characteristics of high efficiency,low cost,but it's hard to get trust of party's credibility,the judicial litigation possesses characteristics of fair,strong credibility,but it always takes a long time to disposal for its low efficiency,high cost.What's more,the current relatively popular third party----medical dispute mediation committee,the writer not only found its successful factors,but dug deeper intoits potential problems.Through the above analysis and the experience at home and abroad,this paper,from the system level,suggested that it is fundamental to improve the whole society synergy governance mechanism,which needs to accelerate the reform of medical system,establish pluralistic mediation model,establish multi-sectoral cooperative engagement of big mediation pattern such as system framework design.From the micro level,it is important to improve the multiple governance ability.And the government needs to change the functions of management,improve the credibility.The court need to enhance the lawsuit system,strengthen the mediation and improve efficiency.Social organizations need to improve the institutional construction,maintain neutrality and professionalism.Insurance institutions should widely share the medical risk and cost burden.The hospital should strengthen management and strengthen the doctor-patient communication.Social media should respect the fact and objective report,disseminate the knowledge of health care and law and spread the positive energy society.Through strenuous efforts from the whole society on improving the governance mechanism and the abilities of multiple governances on the doctor-patient disputes,we could overcome our own weak points by learning from each other's strong points to improve the whole society subject multi-level on participating in the overall level of doctor-patient dispute mediation and governance.
