Study On The Community Correction System Of Juvenile Offenders In China

Over the years, the issue of juvenile delinquency is concerned by people in the whole society. In recent year, with the development of the society, the problem of juvenile crime has become more and more serious. Generally it presents the trend of younger age and organized crime. So how to control juvenile crime has become particularly important. Because of the particularity of juvenile offenders, we can find that there are many drawbacks in the traditional penalty measure. Commonly we may show leniency towards juvenile offenders. The community correction of juvenile offenders is gradually becoming an effective way of execution of punishment. And it has incomparable advantages in the prevention of juvenile crime. However, the community correction for juvenile offenders starts late in our country. It is still in the primary stage and it hasn't formed a complete system. Around these problems, this paper discusses it from four aspects:The first part of this paper introduces the concept of community correction of juvenile offenders. It introduces the definition of juvenile offenders the concept and historical evolution of community correction of juvenile offenders and the significance of carrying out the community correction for juvenile offenders in China.The second part of this paper analyzes the current situation and problems of the community correction of juvenile offenders. This part analyzes this problem mainly from two aspects—the legislation and the practice. In practical analysis, at first the author introduces the systems of the advanced pilot areas and the investigation of the southern area of Henan Province and the author further analyze current problems of it.The third part of this paper mainly introduces the system of foreign countries and what we can learn from them. This part introduces the system of United States, Britain, Japan from two aspects—the setting and the content of the correctional institution.The forth part of this paper offers come suggestion to improve our country community correction of juvenile offenders. In order to solve the common problem of it, we can absorb the advanced experience of foreign countries. When we put forward the suggestion from the aspects of the legislation, the organization and supporting system, we should combine the current situation of our country.
