Research On Product Price Law Regulation Of Public Enterprises In China

Public enterprise is an important part in Chinese economy. Their products are necessities in the material and spiritual life. Their every act and every move is a priority of beneficial to the people's livelihood. Based on the significant roles in Chinese economy and social, public enterprise must set their products' prices cautiously, scientifically and reasonable. But because of the long-term influence of the planned economy, administrative intervention and other unfavorable factors in the process of Chinese social development, the legal regulation of the price mechanism in public enterprise has not yet fully formed. If we do not regulate their product's price, the consumers' rights and Interests will be damaged seriously. The reform of economic system, the sustainable and stable development of economy will be blocked abnormally. From the experiences of England, America and Japan, price regulation is not only simply in order to protect the interests of consumers and maintain social welfare, but also benefits the public enterprises in most cases. Meanwhile it plays the role as the level and stage between the government, the consumer and the enterprises. The legal regulation of the price to the public enterprise in China has been a primary problem. It can not be avoided in the reform of national economic system. In view of this, and based on the ongoing reform of economic system, we will research the legal regulation mechanism of the price to the public enterprise's products from the perspective of economic law. Starting from the analytical of basic concept in public product and its price regulation mechanism, we will elaborate the effects and necessities of this mechanism. We will analyze its current situation and defects from the aspects of mechanism, balance, and its price-forming system. Then we will set the goals and principles of the legal regulation of prices in public enterprises, improve their price legal regulatory system, design their scientific and reasonable pricing methods, establish price-perfecting procedures. Finally we will put forward some reasonable suggestions to price hearing, responsibility, and information disclosure, so as to consummate public enterprises price regulation law.
