Taxi software solves the problem of uneven distribution of the taxi market in our country to a certain extent with its fast and convenient features. However, after two years of development, there are constant internal mergers of taxi software industries and the competition is becoming intensive. It gradually forms the duopoly situation of KUAIDADI and DIDI from the peak time of over 30 taxi software. In order to seize the market, KUAIDADI and DIDI carry out the price subsidy competition: it develops from cash subsidy to the hidden subsidy like red taxi envelope, discount coupon,points for gifts, etc. Currently, there are no provisions of the unfair competition for similar taxi software subsidies in “Combating Unfair Competition” in our country; in the face of fierce competition in the taxi software market, the legislation in our country comparatively lags behind and the general terms and conditions of“Combating Unfair Competition” are not perfect. This paper analyzes the nature of taxi software subsidy from the subjective motive of operators and cost construction of goods based on Article 11 of the “Combating Unfair Competition”. Taxi software is based on its positive externality and usage of software products correlation; its extensive subsidy has obvious predatory characteristic, but the feature of software products and new competition pattern of taxi software industry make the traditional decision criteria powerless. Therefore, according to Article 11 of the “Combating Unfair Competition”, the subsidy of taxi software cannot be lower than the cost price.However, we should also maintain vigilance against innovative business marketing mode that raise the transaction cost of the industry implicitly and should grasp the standard of science and technology innovation and scale of the applicable regulation based on the general principle of whether it is good for people's livelihood development.
