With the development of economy, tourism as an emerging industry is constantly rising. During this process, the problem of selling goods at price lower than cost of unfair competition in the travel agency is serious. The unfair competition of travel agency not only harms the interests of legitimate operators and tourists, but also undermines the development of tourism. It is important to analyze the reasons for unfair competition, strengthen the legal regulation of unfair competition. After analyzing the current situation of travel agency unfair competition, this paper analyzes the deficiencies of legal regulation. Finally, this paper proposes the measures of improving the legal regulation.This article includes three parts in addition to the introduction and the conclusion.The first part is the current situation of low-cost unfair competition in the travel agency. Facing the issue of unfair competition, this paper analyze of the performance,the harm and the reason. The low-cost unfair competition in the travel agency is mainly for zero or negative fare tours. Zero or negative fare tours distort normal profit model, thereby endanger the interests of other operators and tourists, and disrupt the market competition order, indicating that a change in this situation is imminent. This paper analyzes the reasons for zero or negative fare produced from the tourist consumer preferences, asymmetric information, and other aspects of the tourism product homogeneity.The second part analyzes the deficiencies of legal regulation. This part is mainly for the insufficient and the inadequate enforcement of existing laws, the conflicts of judicial and administrative regulation. It is noting that giving the rights to government is an important way of implementing appropriate interventions when the market fails.This part aims to find shortcomings of legal regulations to pave the way of solving the problem in the next part.The third part is proposing the measures of improving the legal regulation. This section proposes improvement measures after a comprehensive analysis of legal problems in low-cost travel agencies. These measures are mainly to improve the relevant laws, the suggestions for law enforcement, the good matching of judicial and administrative regulation.
