Research On The Antimonopoly Law Enforcement System Reform In China

The antimonopoly law is the basic law to maintain the order of the market economy, known as the "economic charter".Since the implementation of China's antimonopoly law in 2008, 8 years ago, to maintain our socialist market economic order, establish and improve the socialist economic legal system has an irreplaceable role. However, with the development of market economy, economy and trade activities have already break through the original fixed pattern,showing a high degree of integration and complexity of the characteristics. In the face of market economic changes, China's law enforcement system exists in the main body of law enforcement is not uniform, the law enforcement power is not concentrated, the operation mechanism of law enforcement is not clear and so on. In practice, the antimonopoly law enforcement often cross, law enforcement conflicts or law enforcement vacuum, lack of supervision and other issues, has seriously affected the development of China's antimonopoly law enforcement work. Therefore, comprehensively deepen the reform of China's anti-monopoly law enforcement system is imperative.In this paper, from the perspective of comprehensive reform of China's antimonopoly law enforcement system,first of all, to outline the concept,characteristics and elements of the law enforcement system as the theoretical basis, and analysis of the current situation of China's anti-monopoly law enforcement system; secondly, a comprehensive analysis summary of China's antimonopoly law enforcement system in the presence of law enforcement body scattered, the lack of independence of the institution, hierarchical relationship is unknown, the quality of personnel is not high, the division of law enforcement authority too scattered, fuzzy and law enforcement organization system is not clear, enforcement procedures are not standardized and law enforcement supervision vacancy main problems; then in reference to the European Union,Japan and the United States in the anti-monopoly enforcement subject setting, on the basis of the division of law enforcement authority and enforcement procedures useful experience, combined with national conditions of our country,puts forward the reform and consummation of China's antimonopoly lawenforcement system is proposed. Through the establishment and improvement of the powers and responsibilities of a unified law enforcement agencies, authority,the authority of law enforcement system and the scientific and orderly law enforcement operation mechanism to achieve the antitrust the effective functioning of the law enforcement system, anti monopoly law and laws and regulations related to the comprehensive and effective implementation of security, standardize the order of socialist market economy.
