As the human Assisted Reproductive Technology generoted and clinical used widely, more and more problems also come with it.The application of the technology will not only impact on sociology, ethics, moral, psychology, education, etc., also strongly shock the existing legal system. At present, the shock of the law performs on the civil legal relationship, little a few involved on criminal law, but as the environment deteriorates and couple of infertility patients increased on the earth, especially the temptation of rich realistic interests in this field, crime of the technology will be substantial in the future. But in the Chinese existing criminal law there is no regulation.Therefore, it is very necessary to study in the field roundly.There are many loopholes on supervision and punishment about misuse of the technology of the Chinese criminal law system.By investigating Chinese present situation, and combined with the experience and practice in some developed countries, this paper discusses the necessity of criminal law regulation of the technology, and makes some suggestions.This paper is divided into four sections.The first chapter, on the present situation of the technology in China, including concept,legislation situation and the judicial practice..The second chapter,Demonstrate the necessity and feasibility of criminal law involved in the field.Due to the serious social harm, shortage of current administrative law, criminal law regulating the limitations and maintaining social order of life science, have to step in the field of criminal law.The third chapter, comparative study on the legislation at abroad.Other developed countries law and judicial practice, after analysis it is concluded that the enlightenment of our country.The fourth chapter, put forward some suggestions on our country criminal law regulation of the technology.
