In the housing commercialization process, property buyers, the commercial housing consumer rights protection more and more attention by people, between commercial housing consumers and developers of the two interdependence and mutual antagonism. But from the reality to see consumers in weak position and often deal with the developers of the deception, fraud and negligence effect caused huge losses,seriously damaged the legitimate rights and interests of consumers of commercial housing. Therefore, how to deal with the problem of housing consumption correctly,and earnestly safeguard the disadvantaged housing legitimate rights and interests of consumers, has become the theory and practice are needed to solve the problem.For the protection of commercial housing consumer rights problems existing in our current situation, this paper has carried on research and discussion, this chapter is divided into four main parts. The first part is the introduction, a brief analysis of the current research status, background and significance of this paper, and the innovation of this paper. In the second part, the sale of commercial housing consumer rights and interests protection outline. Firstly, the paper defines the definition of commercial housing and commodity trading parties, secondly, I summarize the content of the sale of commercial housing consumers and consumer rights and interests, specific right to know, right, punitive compensation claims,warranty against defects in expectation. Finally, relevant laws and regulations to protect the interests of consumers is summarized consumers in China's real estate transaction rights in China as well as the sale of commercial housing. The third part,damage to the interests of consumers in China's real estate transaction. This part mainly analyzes from two aspects because of the imperfect laws and regulations and cause developers. Laws and regulations are not sound reflected in the real estateConsumer protection legislation blank, the punitive compensation is narrow and the pre-sale system is not perfect. Developers causes damage to the interests of consumers is mainly reflected in the developer false propaganda, concealing material facts, postponed others, quality standards and other aspects. The fourth part of our country, improve the protection of consumer's rights and interests. This part mainly discusses from two aspects of laws and regulations and cause developers.Involves is wide because of the commodity apartment consumer's rights and interests protection, this portion of the claim from the aspects of legislation,administration and social protection establish all-round, multi-level and three-dimensional protection system, so as to reduce the loss by commercial housing consumers and promote the development of China's real estate industry and even the whole national economy.
