Research On Ethical Issues Of The Investigative Technical Tactic

The investigative technical tactic is the concept of investigative practice,it is a kind of tactic which concluded by the public security organ and which concluded through the study of information and the characteristics in criminal cases.It is designed to regulate the investigative procedures and improve efficiency.It is the collection of the investigative methods.Essentially,it is the investigative idea and thought.The public security organs pay more attention to the summary and innovation of the investigative technical tactic.Ministry of Public Security specially set up "Study Platform Of National Criminal Information" on its website.The purpose is to select outstanding tactic for national organ's reference.In today's society,we should build the country which can balance the legal and morality.If an investigator can know and grasp the ethical issues when he puts forward a tactic,it is beneficial to the introduction and use of the tactic.Besides the foreword,the paper is divided into four parts, respectively discusses the following questions:The first part is an overview of the ethical issues of the investigative technical tactic of the public security organ.Firstly,this section introduces the ethical scope of the investigative technical tactic.It includes its ethical connotation and extension.Secondly,the section explains the ethical features of the investigative technical tactic.The features are "good" as the center and "justice" as the basic point.Thirdly,the section discusses the ethical significances of the investigative technical tactic.Specifically,The ethics can Standardize the use and coordinate value conflict of the tactic.Moreover,the ethics can promote innovation of the tactic in practice.The second part is the ethical basises of the investigative technical tactic of the public security organ.This section introduces the basic theory and rule of ethics of the tactic.The basic theories are the utilitarian ethical theory of Bentham,the ethicaltheory of Habermas and the ethical theory of Fichte.The basic rules are the rule of the ethics of the bottom line and the rule of the ethics of responsibility.The third part is the ethical dilemmas of the investigative technical tactic of the public security organ.Firstly,the section discusses the dilemma of the conflict of social credibility which the tactic is faced with.It describes the status of the crisis of social credibility. Thirdly,the suggestion is that we should build the system of the ethical institutional of the tactic.We should strengthen the construction of ethical theory, accelerate the construction of ethical legal system and sound the construction of ethical supervision of the tactic.
