The Research On The Group Defamation Directivity

Reputation is an important personal rights. In recent years, with the continuous development of society,the emergence of different forms of defamation disputes bring great challenges to the judicial practice. Based on the defamation disputes,the article focuses on basic issue of the group defamation directivity and combines with the legislation and judicial practice of the Anglo-American law system countries. Finally we put forward the theory of multi-factor consideration in Anglo-American law system,and set up the rules of the group defamation directivity in China.Addition to the introduction,this article is divided into four parts.The first part introduces the significance of the research on the group defamation directivity.In this part, the definition and expression forms of the group defamation disputes are expounded, which makes it different from the general defamation disputes.And it also points to the identification of the status and the necessity of the research on the case of the group defamation disputes.The second part introduces the current situation of the judicial and theoretical research on the group defamation directivity in the Anglo-American law system. In order to provide useful experience for our research,we discusses the development course of the principle of the group defamation directivity in Anglo-American law system, and the general principles and the exception principle adopted by the Anglo-American law system.The third part introduces the theoretical research and legislative judicial status of the group defamation directivity in our country.It mainly includes the research status and deficiencies of China's academic community and judicial practice. on the group defamation directivity.The fourth part introduces suggestions for improvement.This part summarizes the first three parts and points out the deficiencies and advantages of the application of the principles of the Anglo-American law system in this issue. Then it is suggested that our country should draw lessons from the theory of multi-factor in the Anglo- American law system.
