Research On Legal Regulation Of The Non-profit Private Hospitals In China

In recent years,private hospitals have captured a spot on the health service market in China,non-profit private hospitals are the dominant force in the promotion of medical and health services.The sound development of non-profit private hospitals is not only crucial to the establishment of the "three-layer medical service network" that meets people's demand at different levels,but also key to the profit distribution among country,social organizations and individuals.We should proactively develop non-profit private hospitals and ensure that our policies are consistent,scientific and effective.This will help improve the overall quality of healthcare services and make better use of social capital,so that the state and society can make joint investment in healthcare industry.In this way,citizens' access to healthcare shall be guaranteed,social harmony and stability shall be ensured.The definition of non-profit private hospital marks the starting point of this thesis featuring normative analysis,empirical analysis and interdisciplinary research.The thesis analyzes the legal issues concerning non-profit private hospital from the perspectives of market access,market operation and market supervision,it is conducive to the sound development of non-profit private hospitals,the safety and health of citizens as well as social harmony and stability.Firstly,this thesis elucidates the connotation of the non-profit private hospitals by defining the position of non-profit private hospital,the intrinsic relationships between medical service and non-profitability,the rationality of non-profit private hospitals and the source of the non-profit private hospitals.Then,based on current market access mechanism of the non-profit private hospitals,the author analyzes the defects of current market access system of non-profit private hospitals from two aspects namely entity and procedure,which in order to give some advice for improvement.Next,focusing on the problems of non-profit private hospitals in practical operation,ranging from "pricing of medical service","medical support policy","the medical service ability" to "medical market exit",the author wishes to make some points to deepen the cooperation between the hospitals and the government,which will give full play to the macro supervision by government while on the basis of respecting market's decisive role in allocating medical resources.This is the premise for orderly and effective operation of non-profit private hospitals.Finally,from the aspects of internal and external supervision,the thesis interprets the legal regulation issues concerning non-profit private hospitals and makes suggestions that will help improve the non-profit private hospital's market supervision system,from the targeted aspects of self-management regulation,industry regulation,administrative supervision and social supervision.
