The Research Abourt The Existing Problems And Countermeasures Of Local Legislation In Our Country

Local legislation is an important part of socialist legal system, and is an important force to promote local economic, political, cultural and social development. After decades of development, local legislation in China has made great progress, but also greatly promote the development of the local. However, local legislation also has exposed many problems, when it has made great progress. Through to read, analyze and after finishing the relevant literature of our local legislation, then comparing the characteristics of local legislation, the author summarizes some prevailing problems of local legislation currently, including sectoral interests outstanding, lack of legislation characteristics, serious conflict laws, legislative planning not being taken seriously, legislative proposals being single and legislative oversight system not be fully complemented and the like. For the existing problems of local legislation, we can entrust a third party legislation, strengthen awareness of characteristics of legislative workers, establement the approval system before local legislation and the evaluation system after local legislation, implementation the right of legislative initiative of the people's court, procuratorate and stakeholders and establishment the specialized local legislative oversight bodies and other local legislative measures to solve the existing problems. The quality of local legislation is closely related to the masses of the people's interests and the rule of law of the country. Studying the existing problems and solutions of local legislation in depth not only is helpful to promote local development, but also helpful to improve socialist legal system, socialist democracy and to promote the rule of law in the process.
