Study On The Quality Guarantee Of Local Legislation

Local legislation is an important part of the legislative system of our country,the research on local legislative quality problems,help to safeguard and develop socialist democracy,comprehensively promote the rule of law,promote the modernization of national governance,improve the socialist legal system Chinese.However,I Ancient Chinese Literature Search circles for discussion and research is not enough,the existing research is mainly focused on the concept of quality evaluation,the quality of the local legislation of local legislation and standard of the local legislation quality problems,and the underlying causes of the quality of local legislation in China is not high and the adopted effective countermeasures research less.This paper from two aspects of theoretical research and legislative practice,in-depth analysis of the existing local legislation quality problems in China and its reasons,put forward the corresponding countermeasures,in order to enrich the related theory,and help and serve the local legislation practice.This paper is divided into three parts.The first part discusses the basic theory of the quality of local legislation.First of all,define the basic connotation of the concept of local legislation,local legislation quality,determine the scope of theoretical research;secondly,describes the practical significance of local legislation quality,define the research value;finally,analysis standard to judge the quality of the local legislation to pave the way for the following research.The second part discusses the problems of the quality of local legislation in our country and analyzes the reasons.First of all,the existing quality of combing local legislation in China,mainly in the ultra vires legislation,repeated legislation,lagging legislation,local legislation of departmental interests,legislative language is not standardized;secondly,analyze the cause of the quality of local legislation in China is not high,mainly local legislative concept deviation,quality of local legislative personnel is not high,the local legislative authority is not clear,the local legislative procedure of local legislation is not perfect,the technique is not mature.The third part discusses the effective measures to ensure the quality of local legislation in china.In view of the problems and reasons,this part puts forward four countermeasures to guarantee the quality of local legislation in our country.One is to strengthen the construction of local legislative bodies,including establishing legislation of people-oriented philosophy,give full play to the role of the Commission,the relevant structure,improve the comprehensive quality of National People's Congress of the optimization of the local legislative body;two is to clear the local legislative authority,including the legislative power between central and local governments,local authorities and local governments,local people's Congress and its Standing Committee;the three is to improve the local legislative procedure,the main is to improve the local legislative procedure,planning and improvement of local legislation by bill law procedures and improve other procedure of local legislation;the four is to enhance the local legislation,including the upgrading of structure technology and language technology of local legislation.
