Study On The Rule Of Law Thinking And Law Means To Deal With Mass Incidents

At present,our country is in the period of social transition,due to the imperfection of the political and economic system reform,and imperfect legal system,has accumulated many social contradictions in the process.These contradictions in certain circumstances,will be displayed in the form of collective action,the "mass incidents".The disharmonious factors affect China's political stability,order a certain impact on the society,and to get in the way of economic development,caused the party and the government's high attention and academic discussion.Disposal of mass incidents is to explore more,but the role of the rule of law thinking and way of rule of law is often ignored,using the rule of law thinking and way of law discussed the disposal of mass incidents also few.In this paper,the use of the rule of law thinking and way of law analysis and discussions to solve mass incidents,so as to explore the corresponding strategy to deal with the rule of law and the disposal of group events.In this paper,by analyzing the general situation of mass incidents,including the concept of mass incidents,the general characteristics and the cause of the mass incidents,so as to make a brief statement of the current background of mass incidents happened in our country.The author believes that the political system reform lag,emerging economy is not stable,ideally not fully established social structure,imperfect legal system is the important cause of mass incidents happen.And the mass incidents in our country at present the status of the response and disposal is not so satisfactory.The author through the analysis of the principle of disposal of used by mass incidents abroad and domestic disposal principle,and expounds the domestic relevant laws and regulations involving mass incidents,such as:the provisions of the constitution,the provisions of the criminal law,the provisions of the law,and the provisions of the administrative law.Thus summed up the current response and disposal of the lack of the rule of law and the shortcomings of mass incidents,such as:the lack of the rule of law concept,imperfect legislation,and the government's administrative ability is limited,and lack of judicial basis.According to above analysis,the author put forward to deal with and dispose of mass incidents way of thinking and the rule of law under the rule of law be perfected.The traditional social management thought and the way to play a role,but obviously not enough.Diversified plans for specific events pertinence is not strong,pay attention to persuade mediation but can't solve the problem from the source,strengthening the democratic management but lack of democratic supervision mechanism,standardize law enforcement but has not yet formed a set of complete and standard system of the rule of law.Therefore,the author puts forward,in the response and disposal of mass incidents in the future,should insist on fairness and justice,human rights protection,social harmony and the rule of law spirit;With people-oriented attention livelihood of the people,resolve contradictions maintaining stability,handling in accordance with the law enforcement has according to,careful police station the masses for the principle;Choose the correct response and disposal way,such as:in accordance with the law to establish prevention mechanism,establishing the negotiation dialogue mechanism,establish a diversified dispute resolution mechanism,so that the mass incidents can be effectively solved.
