KMT intellectual elite of “Era of public opinion” are different from the conservative's old thought in KMT,and they are different from radical democrats in KMT too. They had harmonic compromise features compare with many factions at that time. They are the KMT party numbers, the social elite of that era, they are the intellectuals of harboring the world at the same time. They have a strong sense of responsibility to the state and the nation. So, this paper intends to study the constitutional concept of Kuomintang intellectual elite of “Era of public opinion”.This paper mainly from the published articles about Constitutionalism and the related system written by intellectual elite of “Era of public opinion” in Kuomintang, and this paper is divided into five pastsThe first chapter induced the founded background and Authors of "Era of public opinion". "National calamity" caused various contradictions prevailing the intellectual at that time urge to start thinking about ways to resolve the national crisis. Domestic Intellectuals made suggestions by creating newspapers and magazines one after another. "Era of public opinion" have come into being in this environment. Some well-known professors from the University of Central created this paper. The article describes the authors group of "Era of public opinion" in detail, and selects the authors group of "Independent Review" and "regeneration" with highly representative. This paper analysis in detail from the geopolitical, occupation, age, representative achievements, the readership and other aspects separately.The second chapter reviews the intellectual's Authoritarian views of "Era of public opinion". The author found that "Era of public opinion" of the Kuomintang dictatorship advocated by the intellectual elite is another form of democracy. Because the dictatorship they advocated required a strong government, a strong leader system and a strong party politics is the "more advanced democracy" have to be.The third chapter discusses the Claims of constitution by Kuomintang intellectual elite of “Era of public opinion”. They advocate that the Constitution must to meet the conditions and culture, respect for human rights, and cultivates people's awareness of the law. They advocated to establish a constitutional nature of the Three People's Principles. They required to achieve dictatorial central administrative section,and they advocate the use of divide and conquer centralization in the area. These ideas was more in line with China's national conditions at the time.The fourth chapter analyzes that the Kuomintang intellectual elite of “Era of public opinion” how to implement constitutional. National Congress was the transition method from the "Party Administering" to "the people" which put forward by the Kuomintang intellectual elite of “Era of public opinion”. They treated it as the most important way to achieve constitutional. At the same time, they are also very concerned about the varieties of problems arised in the judicial system during operation, and they putted forward the corresponding solutions. These views constitute an aspect of the realization of their constitutional system design.In the fifth chapter, the author put the Kuomintang intellectual elite's constitutional concept of “Era of public opinion” into the environment at that time, and compare constitutional concepts with the typical of the "Independent Review" regeneration" intellectuals. Summarizing the typical constitutional concepts of all sectors of the intellectual elite in Nanjing National Government. The constitutional opinions advocated by "Era public opinion" Intellectuals who represents the intellectual elite of the Kuomintang indeed have a great influence on legal thought of Nanjing National Government period. "Era of public opinion" founded from April 1, 1932,and ceased on March 22, 1935, which lasted nearly three years. It is representative the point of view of partisan intellectual, and maintain the interests of the ruling Kuomintang. KMT is very corrupt inside, and they implement the "one-party dictatorship". Because of they are disreputable, the non-party intellectuals criticized intellectual elites of "Era of public opinion" constantly who represents the interests of the KMT. They also attacked by the party diehards, so under the internal and external pressures, the "Era of public opinion" finally ceased publication because of "can not talk about national affairs". To some extent, this is indeed a loss in the history of the development of rule of law in China.
