| The phenomena of employment discrimination are rather common nowadays, which infringe the job-seekers or workers’ rights in equal employment and also cause unstable factors in the society. The existing legal provisions on anti-discrimination in employment in our country are scattered in relevant laws and regulations without having one specific,systematic law of anti- discrimination in employment. These legal regulations do not specify the issues such as "the extent of application", "determination standard of laws of employment discrimination," "burdens of proof", "legal responsibility" and "relief way", which greatly weaken the enforcement effect on legal regulations of anti- discrimination in employment. In addition, our country did not pay attention to the enforcement of employment discrimination legislation. Our country haven’t established the specialized enforcement body for anti-discrimination in employment and are lack of effective relief way.Therefore, the writer hopes that by studying the legal regulation of employment discrimination in our country so as to improve legislation on anti-discrimination in employment, providing important theoretical basis and legal research foundation to the country. The writer also looks forward that our country will construct sound and comprehensive legal system on anti-discrimination in employment as early as possible. In this paper, the main body is divided into three chapters. The first chapter is about the basic problem of employment discrimination and legal regulation. This chapter mainly described the basic problems of employment discrimination as well as the legal regulation of employment discrimination. The second chapter analyzed the theories of legal regulations of employment discrimination, and summarized the theories which are able to solve current problems of employment discrimination,providing a theoretical basis for anti-discrimination in employment. In view of the deficiencies and defects of legal regulation of employment discrimination proposed in the first two chapters, the third chapter proposed the perfection of legal regulations of employment discrimination from the aspect of legislating specific law of antidiscrimination in employment; specifying the core elements of laws of anti-discrimination in employment; strengthening the relief way of laws of anti-discrimination in employment. |
