Research On The Court Judicial Administrative Affairs Management And Trial Separation Mechanism In China

Under the background of judicial system reform, especially after the Eighteenth class third?fourth and fifth plenary session which focus on the rule of law and reform of the judicial system,the judicial status of China got higher attention. As the reform in all areas is deepening, People's demand for fairness and justice is getting higher and higher, the Court as the last line in fairness defending and the judges as the defenders of fairness and justice, there is doubtless on the importance of the Courts and judges function well.In the realistic judicial environment in our country, the Court and the judge are involved in judicial administrative affairs, which is harmful to the judicial autho rity function independently?fair and efficiently as well as the proper role that the Court and the judge plays. Although the effect of the administration of justice transaction management and security of judges jurisdiction independent, impartial and efficie nt exercise of judicial reform has never been stagnant, but the reform has not get to the right place. To the Chief Justice, the case examination and approval system reform, job security and other judges have not been effectively resolved and dealt with, resulting in China Judicial and Administrative affairs and management of the exercise of judicial power in the chaos and always "out of bounds."In this paper, judicial independence, fair and efficient exercise of judicial separation mechanism perspective to study the management of administrative affairs of the Court and the jurisdiction of the Construction, through relevant concepts and existing systems analysis and summary, in comparison extraterritorial related systems comments and suggestions related to reform in our country on the basis, in order to provide reference for the reform of related systems in China.
