The Research On The Problem And Countermeasure Of Transparency In Prison Operations In Hunan Province

When people mentioned the prison, it always makes them thought of majestic iron gate, terrible walls and gird, high—rise towers and serious armed police. The prison has always been given a mysterious color to the public who think there is another unknown world in there. Transparency in prison operations look like an“sunshine system” to prison, let the prison disclosures these operations including main basis of law enforcement, enforcement procedures and enforcement results to public in proper ways, and accept supervision of society such as criminals and their families, and general public. Therefore, transparencies in prison operations are effective measures to eliminate prison's stereotype and perform Prison's Administration by Law as well. It shows the progress of Chinese legal system construction and civilized law enforcement.Starting from the actual situation of transparency in prison operations in Hunan province, the thesis studies the problems of transparency in prison operations. This paper first reviews the relevant theories at home and abroad, such as Disclosure of Government Information, Public Relations, Criminal Rights, Transparency in Government Operations. With instruction of the Prison Law of the People's Republic of China and relevant politics, defining the core concept and refining the characteristics of transparency in prison operations that are legality, diaphaneity, and publicity, dynamic and convenient. Proceeding from these characteristics, the thesis comprehensively summarizes the basic steps and shortcoming in practice in Hunan province, which the public system has not been unified, the public content has not been comprehensive, the public channel has not been complete, and the public coordination mechanism has not been formed. On these basis, it analyzes the multiple constraints for transparency in prison operations in Hunan province, which are subject limited cognition, lack of basic transparency conditions, not implemented administration by law, and supervision is not effective to work. At last, combining the practical experiences at home and aboard, it points out a realization path for transparency in prison operations in Hunan province. That is to say, prison management in Hunan province should build up four systems that are law protection system, executive system, supervision system and evaluation system of transparency in prison operations. These are not only benefit to improve the quality of prisonmanagement, but also maintain the authority of prison law enforcement. It has important significance to build a justice environment as well.
