Study On Judicial Publicity In E-Age

Even if judicial publicity has seen both new opportunities and arduous challenges in E-age, it undoubtedly can urge judges to consciously improve judicial competence and standardize judicial acts, and can contribute to prevention of judicial corruption and backroom deal, exerting positive effects on judicial fairness promotion, public credibility improvement and judicial authority establishment. Statistics by empirical research indicate that both parties in action and the public have expectations about judicial publicity, and active measures have been taken by courts, but a great distance between transparency level and people's expectation still exists. Reasons can be presented on three levels: theoretically, judicial publicity faces multiple contradictions; objectively, institutional supply, hardware equipment and social environment of judicial publicity are immature; subjectively, there exist barriers of ideological misunderstanding, insufficient confidence of judicial publicity and irregular judicial acts. As a consequence, in E-age, by strictly following judicial principles, we should take people's judicial needs as foothold to completely eliminate ideological obstacles of judicial publicity; we should detail rules of judicial publicity and strengthen basis of hardware equipment to establish a rational judicial environment; we should build coordination system of judicial publicity based on micro-level to define reasonable publicity extent and standardize judicial acts; we should implement procedural guarantee of judicial publicity to ensure that judiciary is confident and capable enough to stand in front of parties in action and the public, expecting in-depth and substantial publicity step by step.
