The Efficiency Analysis Of The Standard Form Contract

The standard form contract drafted in advance, for repeated use, does not negotiate with others. The standard form contract is widely exists in our social life and economic life. When a baby is born, the baby’s parents signed a medical service contract with the hospital, when the old man died, riding a crane to the west, the elderly’s children and other relatives signed a standard form contract with the funeral hall. Our daily life about eating, drinking, shopping, accommodation, travel, communication, heating, respectively relative with restaurants, water companies, department stores, real estate companies, communication companies and heating company to establish the format contract.The first chapter of this paper introduced the concept of the standard form contract and the historical sources.The historical sources of the standard form contract include a large number of repeat transactions,the professional and the transaction security requirements.The second chapter and the third chapter analyzed the efficiency of the standard form contract under the condition of free competition market and the monopoly market.The second chapter analyzed the efficiency of the form contract in the condition of the two kinds of situations, there is no transaction costs and the existence of transaction costs includes two cases of legal regulation and no legal arrangement.The third chapter analyzes the efficiency of the standard format contract at the monopoly market with legal regulation and without legal regulation, afterwards discussed the current hot issues about the problem of the valuation clause of express and mobile data traffic cleared problem.Finally according to different market conditions, the paper puts forward different legal regulations and introduces the legislative status of the format contract and the countermeasures and suggestions.
