Imbalance Between Information Sharing And Copyright Protection And Its Countermeasures In The Network Environment

Information sharing is the right of aspirations to information for citizens which represents the interests of the public. Copyright protection is special rights given to creators of intellectual achievements, which embodies the personal profits of the copyright owner. However, in current network environment, the development of digital and network technologies bring the reproduction and dissemination of works unprecedented convenience, it creates conditions for the construction and sharing of information resource. This development meets the public demand for information in one side, but on the other hand, it infringes the rights of owners. The contradiction gives rise to the imbalance between information sharing and copyright protection in the network environment. In this case, how to balance the interests of both sides, to coordinate the relationships between information sharing and copyright protection, winning full realization of the resource sharing and the effective copyright protection for owners is the goal of this study. This paper first analyzes the property of information sharing and copyright protection under network environment, and paves the way to study the reasons for the imbalance of information sharing and copyright protection in the network environment, this paper also combined with domestic and international experience in network copyright legislation and explores solutions to imbalances between information sharing and copyright protection. The paper is divided into the following sections:The first part is the introduction section. It introduces the research background and significance, current research status, content and methods, and the innovations.The second part analyzes the rationality of balance of information sharing and copyright protection under network environment, which supplies the theoretical base for the further research on unbalanced information sharing and copyright protection.The third part is the research of unbalanced information sharing and copyright protection in network environment. This part probes unbalance causes by analyzing the unbalanced performance of information sharing and copyright protection in network environment.The fourth part discusses the countermeasures for information sharing and copyright protection with legal view. Namely, this part analyzes the countermeasures for unbalanced information sharing and copyright protection in network environment from the aspects of the right protection and limitation of copyright law, illustrating and concluding relating laws and regulations of domestic and overseas.The fifth part analyzes the countermeasures of unbalanced information sharing and copyright protection in network environment from aspects of copyright management. Namely, it discusses copyright management and applying in network environment by probing copyright management models, authorization ways, and network morals.The sixth part presents the countermeasures of unbalanced information sharing and copyright protection in network environment from aspects of Economics. It analyzes the reasonable pricing in equilibrium theory, and the possibility of undertaking compensation payment system for copyright in optimum theory.The seventh part is a summary of this paper, and explores the inadequacies and research prospects.
