Historically, homosexuality is not unusual. However, homosexual marriage is hardly recognized. The traditional view of marriage is a combination of both sexes,that is heterosexual marriage. But, with the development and progress of the times, human society broke the traditional view and people began to fight for homosexual marriage rights. Nowadays, Human Rights awakens the desire of homosexuals for homosexual marriage. Analytical, comparative and inductive research methods,the author summarizes suitable legislative model for our country, through foreign investigation and Chinese actual situation, and puts forward practical suggestions for our country's countermeasures to homosexual marriage.The main content of this paper is divided into four parts:Chapter I is about the recognition of same-sex marriage. The author describes the meaning and development of homosexuality and same-sex marriage, the relationship between homosexuality and same-sex marriage, and the similarities and differences between same-sex marriage and heterosexual marriage.That confirmed the existence of homosexuality is since ancient times, not modern society.And homosexuality is a normal phenomenon,not mental illness. There is no real difference between same-sex marriage and heterosexual marriage in essence. Considering,the chapter is to establish a right foundation for this writing research.Chapter II is mainly about our current discussions on same-sex marriage,Including the supported views and opposing views. Supporters generally consider the issue of human rights protection, while opponents argued that same-sex marriage undermines traditional marriage, is detrimental to the growth of children.the chapter leads to the following Justification of Legal same-sex marriage.Chapter III focus on the biological basis of homosexuality,Legal theory, legal foundation of legalize same-sex marriage and social foundation.That proved the legitimacy and feasibility of gay marriage, providing a proper theoretical basis for writing this article.Chapter IV is mainly about the issue of same-sex legislation with prospects,This chapter is divided into two parts. The first part mains to introduce the general legislative situation of the same—sex marriage in areas in the world,including same-sex marriage system in several countries, summing up that the same—sex marriage legislation can be roughly divided into four modes. That can help us to learn the modes about homosexual combination. On the basis of the former part,The second part focus on the issue of a registration system for same-sex partners in our country. And some suggestion about rights and obligations.
