Research Of Improving The Regulatory Legal System Of Internet Private Hire Vehicles

“Internet Private Hire Vehicles”(IPHV) including network reservation private car services, and network reservation taxi limousine service, is a new form of shared economy in the mobile Internet era. In China, the IPHV was born in 2010, and had developed for only about six years.Currently, both the development of the IPHV, and the regulation of government, are still in the exploratory stage. IPHV has the characteristics of shared economic of the mobile and Internet era, and its development process presents the characteristics of the stage. At present, IPHV of China is moving towards the direction of more meticulous. However, our legal system of IPHV exists the problem of chaotic system, legal positioning of the IPHV is not clear, security responsibilities are not clearly demarcated, consumer protection mechanisms are inadequate and so on.I put IPHV into the global perspective to inspect, and learn from outstanding legal supervision system and successful experience from overseas of the legal system of IPHV. The main draw includes legislation designed to maintain regulatory philosophy with the times, moderate to regulate the legal system innovation, focusing on consumer protection, as well as focus on improving IPHV process supervision system. I believe that the following aspects should improve the management system of our own: improving norms, enhancing the concept of administrative regulation, strengthening the industry self-regulation and consumer protection.In fully understand of our problems of legal system about IPHV, and a summary of extraterritorial successful experience on the basis, I believe that to improve our network about IPHV supervision legal system should be implemented to encourage innovation and ensure order and balance the interests of legal objectives, adhere to the IPHV difference with the traditional management, taking into account the overall efficiency and equity principles of urban passenger transport market. In the specific design of the system, I propose a clear legitimacy of IPHV from the legislative, regulatory approach establishing a network of about IPHV platform, the market access system of IPHV, a clear division of responsibilities network about car safety, and improving consumers' rights protection system of IPHV.
