The Relation Of Performance Examination To The Operation Of The Procuratorial Authority

The current performance examination in our procuratorial organs has been designed to pay more attention to promote the efficiency of procuratorial work and ignores that it may lead to incorrectly exercising procuratorial power, which brought a series of problems. This paper focuses on the performance examination in procuratorial organs and the relation of this system to the operation of the procuratorial authority by empirical study. Then, try to give some suggestions to the improvement of this system.This paper is divided into four chapters.The first chapter mainly introduces the process of the establishment, the improvement and the adjustment of the performance examination in procuratorial organs, then it introduces every kind of examination system in four couples of categories. The performance examination has been established in our country for nearly twenty years. It indeed has an affection on the promotion of the efficency in procuratorial work and it's also an inevitable selection of the procurator's management system.The second chapter introduces the characters of the current performance examination by empirical analysing materials of City N, Province J. These characters include the complicated examination contents, too many quantitative indexes and the changing performance examination system in very short time. All these influence the exercising procuratorial power.The third chapter focusing on the analysis of the effects of the performance examination to the prosecutorial power's exercise. Such as, the utility of purpose evaluation increased “flow operation” carries of the criminal litigation structure. The unreasonable indexes led to incorrectly exercising procuratorial power. Changing performance examination affected the judicial justice. And the performance examination which attaches great importance to the entity than the procedure causes avoiding due procedure.The fourth chapter according to the analysis of the influences of the performance examination to the exercising procuratorial power mentioned above, puts forward some suggestions to perfect the system. Mainly includes focusing on procurators' performance instead of procuratorate's, increasing the program assessment of the value, setting common and characteristic indexes.
