The NSA Prism Program scandal, which happened in 2013, sounds the alarm of cyber security in many countries. While reshaping people's everyday life and creating countless opportunities and facilities, cyber technology also causes a variety of cyber security problems, like cybercrime, information leak, and cyber terrorism threats, which plaguing a lot of people. With the rapid development of China's science and technology as well as the deepening of international trade, China's economy grew by leaps in the past years. However, cyber security problem is becoming worse and worse. How to deal with cyber security crises that may occur? How to control and curb these threats? What kinds of actions we can take? What our laws and regulations can do when technical means cannot end these threats?Focusing on the above questions, this paper analyzes U.S. legislation on cybersecurity, comprehensively summarizes the relative papers and books, analyzes legal protection issues of cyber security by combining existing cybersecurity theory and legislative achievement, and provides some suggestions to strengthen China's legislation on cybersecurity. The paper is divided into five parts: the first part is introduction, which introduces the research background of this paper. There are three total trends in cybersecurity, cyber security problem is becoming worse and worse, more and more people care about cyber security, and the United States has a special status in governing cybersecurity. Based these, the paper emphasizes the its research purpose and importance and then gives its main structures; The second part is the literature review of relative researches, which summarizes domestic and international researches of the definition, contents, and characteristics of cybersecurity, and the U.S. legislative process on cybersecurity in past years. The third part reviews U.S. legislation process on cybersecurity, and divides the process into three stages, which are the initial establishment stage(before 2001), the exploring and improving state(2002 to 2009), and the fully promote stage(2009 till now). The paper then summarizes and analyzes the current status of U.S. cybersecurity legislation. The fourth part introduces the main contents of U.S. cybersecurity laws and regulations, and deeply analyzes the 5 main issues in U.S. cybersecurity legislation. These issues are cybersecurity information sharing, critical infrastructure protection, cybersecurity workforces, cybersecurity technology research and development, and the authorization mechanisms of the Department of Homeland Security. The fifth part provides some policy suggestions on China's cybersecurity legislation. In this part, the paper analyzes experiences and implications of U.S. cybersecurity legislation, threats of China's cybersecurity, and the cybersecurity legislation process and current status in China. Base on the U.S legislation experiences and China's special situation, the paper provides several suggestions on China's cybersecurity legislation. The last part is conclusion, which summarizes the whole contents of the research.
